GENERAL TERMS AND CONDITIONS OF SALE AND USE

ARTICLE 1 - PURPOSE AND SCOPE
These General Terms and Conditions of Sale and Use (hereinafter referred to as the "GTCU") govern access to, use of and transactions on the website www.lalumierecmworld.comThis website is the property of LaLumiereCM World e.K., HRA 13362, Ludwigstraße 36, 66115 Saarbrücken, Germany.
The site enables :
- direct sales of products by LaLumiereCM World in the fields of beauty, well-being, lifestyle, children and design;
- the provision of creative, event, design or coaching services offered by LaLumiereCM or its partners;
- bringing third-party sellers and customers together via a dedicated digital platform;
- putting people in touch with each other for seasonal real estate activities;
- participation in entrepreneurial development initiatives;
- and the promotion of solidarity projects via the "Faith is my Hope" foundation.
LaLumiereCM World acts as a :
- Direct seller its own products and services, in which case it is a contracting party in the strict sense;
- Platform operator technical services for products or services marketed by third-party sellers, in which case it acts as an intermediary without intervening in the contractual relationship between the third-party seller and the buyer.
By accessing the site or using its services, all users unreservedly accept these GTCU.
ARTICLE 2 - CONDITIONS OF USE OF THE SITE
Access to the site is open to anyone of legal age or with parental authorisation. It is forbidden to use the site for fraudulent, illegal or abusive purposes. Any violation may result in immediate suspension of access.
The user undertakes to provide accurate, up-to-date and complete information when creating an account or placing an order.
ARTICLE 3 - PRODUCTS AND SERVICES
The products on offer include
- beauty, cosmetics and well-being products,
- educational toys and creative materials for children,
- lifestyle accessories and decorative items,
- crafts and artistic creations.
Services include :
- graphic design, styling and interior design,
- event organisation and decoration,
- entrepreneurial and artistic coaching,
- the provision of digital training modules.
Certain products or services may be limited in quantity or geographical area, and may be subject to special conditions communicated before the order is placed.
ARTICLE 4 - MULTI-SELLER PLATFORM
LaLumiereCM World provides a technical infrastructure enabling third-party sellers to offer their products or services on the platform.
In this context :
- LaLumiereCM acts as host and facilitator of the transaction;
- The sales contract is formed directly between the third-party seller and the end buyer;
- Third-party sellers are legally bound to comply with all the applicable provisions of consumer law, in particular the obligation to provide pre-contractual information, the right of withdrawal, the legal guarantees of conformity and hidden defects, as well as the rules relating to invoicing, VAT and product safety;
- They must ensure that their products comply with the standards in force in the countries of destination, particularly in terms of health, safety and labelling;
- LaLumiereCM declines all responsibility for any failure by the third-party seller to meet its contractual or legal obligations;
- LaLumiereCM cannot be held responsible for any dispute relating to the delivery, quality or conformity of products or services offered by third-party sellers;
- The platform reserves the right to suspend, restrict or remove a third-party seller's access to the user interface at any time in the event of non-compliance with applicable laws, these terms and conditions or in the event of repeated customer complaints.
ARTICLE 5 - PRICING CONDITIONS
All prices are in euros and include VAT. They are subject to change without notice. Delivery charges, if any, are specified when the order is placed.
For services, personalised quotations can be drawn up. Any down payments, lead times and withdrawal conditions are specified in each individual quotation.
ARTICLE 6 - PAYMENT TERMS
Payment is made using the secure methods offered on the site (bank transfer, credit card, PayPal). All transactions are encrypted and processed in accordance with current security standards, in particular SSL/TLS protocols, to ensure the confidentiality of bank details.
In the event of non-payment, a payment incident or rejection, the order will be automatically suspended until the situation is rectified. Any attempt at fraud, identity theft or unauthorised use of a means of payment will result in immediate suspension of the account concerned and may be subject to legal proceedings. LaLumiereCM reserves the right to retain all electronic evidence necessary for this purpose.
ARTICLE 7 - DELIVERY AND AVAILABILITY
Delivery times are given for information only. LaLumiereCM undertakes to inform the purchaser of any foreseeable delay. Products are delivered to the address indicated by the customer. The seller's liability applies until the actual delivery of the product.
ARTICLE 8 - RIGHT OF WITHDRAWAL
Consumers have a legal period of fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without having to justify their decision or pay any penalties, in accordance with the European Consumer Code.
To exercise this right, the purchaser must notify their decision to withdraw using the form available in the dedicated section of the site or by email to the following address: lalumierecm@gmail.com. The form must be completed and sent before the legal deadline expires.
Products must be returned to the address provided by Customer Service, in their original condition, complete, unused and in their original packaging. Unless otherwise specified, the cost of returning the goods is borne by the purchaser.
The refund, including the initial standard delivery costs, will be made within a maximum of fourteen (14) days from the date of receipt of the returned products or the proof of dispatch provided by the customer. The refund will be made using the same method of payment as that used for the order.
Certain products or services are excluded from the right of withdrawal, in particular personalised products or products made to the customer's specifications, perishable goods, downloaded digital files and services performed before the end of the withdrawal period with the customer's express agreement.
ARTICLE 9 - LIABILITY
LaLumiereCM may not be held liable for indirect or immaterial damage. Its liability is limited to the amount of the order concerned.
It declines all responsibility for products and services offered by third-party sellers. The user acknowledges that in the event of a dispute with a third party, LaLumiereCM may only be prosecuted in the event of a proven fault in the operation of the platform.
ARTICLE 10 - INTELLECTUAL PROPERTY
All content on the site (text, images, videos, logos, trademarks) is protected by copyright and remains the exclusive property of LaLumiereCM or its partners. Any reproduction or use without prior written authorisation is prohibited.
ARTICLE 11 - SOCIAL AND COMMUNITY INVOLVEMENT
LaLumiereCM World supports solidarity projects, in particular the association "Faith is my Hope", through communication campaigns, sponsorship or voluntary donations. These actions do not entail any obligation of result or consideration for the user or customer. They do not confer any right to a refund, reduction, priority of service or specific service. Support actions are voluntary and non-contractual.
ARTICLE 12 - PERSONAL DATA
The personal data collected is processed in accordance with the General Data Protection Regulation (RGPD). It is used to manage orders, customer relations and site security. Users may exercise their rights of access, rectification or deletion by contacting : lalumierecm@gmail.com
ARTICLE 13 - AMENDMENTS TO THE GVCS
LaLumiereCM reserves the right to modify these GTCU at any time. The applicable version is the one published online at the time of the order or access to the service. We recommend that you consult them regularly.
ARTICLE 14 - APPLICABLE LAW AND DISPUTES
These GTCU are governed by German law. In the event of a dispute, the parties shall endeavour to find an amicable solution. Failing this, the courts of Saarbrücken shall have sole jurisdiction.
